SIA Blake Investments, registration No. 40203214971, legal address: Dubultu iela 21-7, Riga, LV-1029 (hereinafter – the Seller), offers for purchase on its website a digital product — the Money Archetype Test (hereinafter – the Test). By using the website and making a purchase, the Buyer confirms that they have read these terms and agree to comply with them.

These terms constitute a distance contract within the meaning of the Consumer Rights Protection Law of the Republic of Latvia. The laws and regulations of the Republic of Latvia apply to the contract, including the Consumer Rights Protection Law and Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”.

1. General Terms

1.1. The Seller sells a digital product — the Money Archetype Test, the result of which is delivered electronically in PDF format to the email address provided by the Buyer.

1.2. The Test is intended for self-assessment and informational purposes only. It does not constitute individual financial advice and is not to be regarded as an investment service within the meaning of the Financial Instrument Market Law.

1.3. The Buyer confirms that they are at least 18 years old and acting on their own behalf. If the Buyer is a legal entity, the provisions of this section regarding the right of withdrawal do not apply.

2. Order Placement

2.1. The Buyer selects the Test on the website, enters an email address and other required order details, reviews these terms, and completes the payment.

2.2. Before payment, the Buyer confirms agreement with these terms, as well as consent to the immediate delivery of digital content and acknowledgment of the loss of the right of withdrawal in accordance with Section 5 of these terms.

2.3. The contract between the Buyer and the Seller enters into force at the moment the Buyer successfully completes payment and receives payment confirmation to the specified email address.

3. Price and Payment Terms

3.1. The price of the Test is indicated next to the product on the website. The price is stated in euros (EUR) and includes all applicable taxes.

3.2. Payment is made online via the payment platform Maksekeskus AS (makecommerce.lv). Available payment methods:

• Latvian online banking payments: Swedbank, SEB, Citadele, Luminor;
• Visa and Mastercard card payments.

3.3. Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS in accordance with its privacy policy.

3.4. If payment fails or the order cannot be fulfilled due to technical reasons, the Buyer is informed and any received amount is refunded no later than within 14 days.

4. Delivery of Digital Content

4.1. After successful payment, the Test result in PDF format is automatically sent to the Buyer’s provided email address, usually within a few minutes.

4.2. If the Buyer has not received the Test within 24 hours after payment, they should check their spam/junk folder and contact the Seller at welcome@baibablake.eu.

4.3. The Buyer is responsible for providing a correct email address. The Seller is not liable for delivery issues caused by an incorrect address, a full inbox, or email filtering by the Buyer’s email service provider.

4.4. The Seller delivers digital content within the European Union. The Buyer’s geographic location does not affect delivery availability unless restricted by law.

5. Right of Withdrawal

5.1. A consumer (a natural person purchasing a product for purposes not related to their trade, business, craft, or profession) generally has the right to withdraw from a distance contract within 14 calendar days.

5.2. In accordance with Section 22.13 of Cabinet of Ministers Regulation No. 255 of 20 May 2014, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium, if:

• the delivery of digital content has begun with the Buyer’s prior express consent; and
• the Buyer has acknowledged the loss of the right of withdrawal.

5.3. By placing an order and confirming these terms, the Buyer:

• expressly agrees that the delivery of digital content (Test PDF) begins immediately after payment; and
• acknowledges that they thereby lose the 14-day right of withdrawal.

5.4. This provision does not limit the Buyer’s right to request a refund in case of technical issues under Section 6 of these terms, nor the right to request remedies for non-conformity of digital content under Section 7.

6. Refunds in Case of Technical Issues

6.1. The Seller shall refund the paid amount if:

• the Test PDF file is not delivered to the Buyer within 24 hours after payment, and the Seller is unable to ensure delivery within 5 business days after being notified by the Buyer;
• the delivered PDF file is corrupted or cannot be opened, and the Seller is unable to provide a working file within a reasonable period;
• the delivered content significantly differs in scope or substance from the description provided on the website.

6.2. The refund request must be sent by the Buyer to welcome@baibablake.eu, including the order number, payment date, and description of the issue.

6.3. The Seller reviews the request and responds in writing within 15 days. If the request is justified, the refund is issued using the same payment method used for the original transaction, no later than within 14 days.

6.4. No refund is issued if the Buyer has received a fully functional Test PDF and the reason is subjective or personal (for example: dissatisfaction with results, disagreement with interpretation, or change of opinion).

7. Claims Regarding Non-Conforming Digital Content

7.1. The Seller is liable for the conformity of the digital content with the contractual terms in accordance with the Consumer Rights Protection Law.

7.2. If the Buyer identifies any non-conformity (for example, errors in the document, technical issues, or content not matching the description), they shall notify the Seller within a reasonable time after discovering the non-conformity by writing to welcome@baibablake.eu.

7.3. The Seller shall remedy the non-conformity within a reasonable period at no additional cost. If remedy is impossible or disproportionate, the Buyer is entitled to a full or partial refund of the paid amount.

7.4. The Seller shall respond to the Buyer’s complaint in writing within 15 days.

8. Intellectual Property

8.1. The content of the Test, questions, result interpretations, and the design of the PDF document are the intellectual property of the Seller and are protected by copyright.

8.2. The Buyer is granted a personal, non-exclusive, and non-transferable licence to use the received Test result for personal purposes.

8.3. It is prohibited to republish, distribute, sell, commercially reproduce, or make the content available to third parties without the Seller’s written permission.

9. Personal Data Processing

9.1. The Seller processes only the personal data provided by the Buyer when placing the order (for example, name, surname, email address, and answers to the Test questions).

9.2. The purpose of processing is the performance of the contract — preparation and delivery of the Test result, as well as compliance with accounting and tax requirements.

9.3. Data required for payment processing is transferred to the licensed payment institution Maksekeskus AS.

9.4. If the Buyer has given explicit consent, the Seller may send information about new products, offers, and content. The Buyer has the right to opt out of marketing communications at any time by writing to welcome@baibablake.eu or by using the unsubscribe link in the email.

9.5. Detailed information on data processing is available in the Seller’s Privacy Policy.

10. Limitation of Liability

10.1. The Test is intended for self-assessment. Its results are not to be considered as individual financial, legal, or psychological advice. The Buyer is solely responsible for any decisions made based on the Test results.

10.2. The Seller is not liable for failure to perform or delays in performance caused by circumstances beyond the Seller’s reasonable control (for example, internet connection issues, payment platform malfunctions, force majeure events).

11. Dispute Resolution

11.1. In matters not regulated by these terms, the Buyer and the Seller shall comply with the applicable laws and regulations of the Republic of Latvia.

11.2. All disputes shall be resolved through negotiation. If an agreement cannot be reached, the Buyer, as a consumer, has the right to обратиться to the Consumer Rights Protection Centre (Brīvības iela 55, Riga, LV-1010, www.ptac.gov.lv) or use the European Union online dispute resolution platform (ec.europa.eu/consumers/odr).

11.3. Disputes that cannot be resolved through negotiation or via the Consumer Rights Protection Centre shall be settled in the courts of the Republic of Latvia in accordance with applicable laws.

12. Amendments to the Terms

12.1. The Seller has the right to unilaterally amend these terms by publishing the updated version on the website. The terms in force at the time of placing the order shall apply to that order.
